Welcome to DigiPromise (“Website” / “Service”), operated by DigiPromise, a Dubai-based AI automation agency. By purchasing, accessing, or using any DigiPromise service, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions and our Refund & Cancellation Policy below. If you do not agree, please do not proceed with any purchase or use of our services.

1. Acceptance of Terms

By completing a purchase or accessing DigiPromise services, you confirm that:

  • You are at least 18 years old or the legal age of majority in your jurisdiction.
  • You have the legal authority to enter into a binding agreement.
  • All information you provide during checkout is accurate and complete.

2. Changes to Terms

We reserve the right to update these Terms at any time. Changes take effect upon posting to this page. Your continued use of the Service after changes are published constitutes your acceptance. We recommend reviewing this page periodically.

3. Services

3.1 What We Provide

DigiPromise offers done-for-you AI chatbot and lead generation agent services. Upon purchase, our team builds, trains, and deploys a branded AI agent on your website and/or WhatsApp channel within 24 hours, as described in the plan you selected at checkout.

3.2 Plan Inclusions

Each plan (Starter, Growth, Scale, Enterprise) includes the features listed on the pricing page at time of purchase. Feature specifications are subject to change with reasonable notice to active subscribers.

3.3 Onboarding

After purchase, DigiPromise will contact you to collect your business information, brand assets, and deployment preferences. Starter plan clients are contacted by email; Growth and above are contacted directly. Timely responses from you are required to meet the 24-hour deployment commitment.

4. Payment & Billing

  • All prices are listed in USD. AED-equivalent pricing may be shown for UAE customers.
  • Subscriptions are billed monthly or annually depending on the plan selected at checkout.
  • Payment is processed securely via Stripe, Paymob, or other authorised payment processors.
  • By providing payment details, you authorise DigiPromise to charge the applicable amount on a recurring basis until cancellation.
  • Failed payments may result in suspension of your service until resolved.

5. Refund & Cancellation Policy

5.1  7-Day Money-Back Guarantee

We stand behind our service with a 7-day money-back guarantee on all plans. If you are not satisfied with your deployed AI agent within 7 days of going live, we will first attempt to resolve the issue. If you remain unsatisfied after our resolution attempt, we will issue a full refund — no questions asked.

To request a refund under this guarantee:

  • Email [email protected] within 7 days of your agent going live.
  • Include your order details and reason for the refund request.
  • Refunds are processed within 5–10 business days to the original payment method.

5.2  Cancellation Policy

You may cancel your subscription at any time by emailing [email protected] or through your account portal.

  • Cancellations take effect at the end of the current billing cycle.
  • You will retain access to your agent until the end of the paid period.
  • No partial refunds are issued for unused days in the current billing cycle, except where the 7-day guarantee applies.
  • Annual plan subscribers who cancel after 7 days are not eligible for a pro-rata refund of the remaining term.

5.3  Non-Refundable Items

The following are non-refundable:

  • One-time add-on purchases (RAG training, CRM integration, branding removal) once work has commenced.
  • Extra message top-ups once credits have been consumed.
  • Custom Enterprise builds once the scoping and build phase has begun.
  • Any subscription fees after the 7-day guarantee window has passed.

5.4  Refund Exceptions

DigiPromise reserves the right to decline a refund if:

  • The client failed to respond to onboarding outreach within 72 hours, causing a deployment delay.
  • The refund request falls outside the 7-day guarantee window.
  • There is evidence of abuse of the guarantee (e.g., repeated purchases and refund requests).

6. Acceptable Use

You agree not to use DigiPromise services to:

  • Violate any applicable law or regulation.
  • Transmit harmful, offensive, or misleading content through your AI agent.
  • Attempt to reverse-engineer, copy, or resell DigiPromise’s AI infrastructure or workflows.
  • Engage in spamming, phishing, or any deceptive practice.

Violation of acceptable use may result in immediate suspension without refund.

7. Intellectual Property

All DigiPromise branding, systems, workflows, and training methodologies remain the intellectual property of DigiPromise. The branded AI agent deployed for your business is licensed to you for use during an active subscription.

Content you provide for training (FAQs, pricing, product info) remains your property. By submitting it, you grant DigiPromise a limited license to use it solely for the purpose of building and maintaining your agent.

8. Limitation of Liability

To the fullest extent permitted by applicable law, DigiPromise, its founders, employees, and affiliates shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service, including but not limited to lost revenue, missed leads, or data loss.

Our total liability for any claim shall not exceed the amount paid by you in the 30 days preceding the claim.

9. Disclaimer of Warranties

Our services are provided “as is” and “as available.” We do not guarantee that the AI agent will capture every lead, answer every query perfectly, or operate without interruption. AI outputs may occasionally require human review. DigiPromise is not liable for business decisions made based on AI-generated responses.

10. Privacy

Your use of our services is subject to our Privacy Policy available at digipromise.com/privacy. We take data protection seriously and comply with applicable UAE data protection standards.

11. Termination

DigiPromise may suspend or terminate your access immediately and without notice if you:

  • Violate these Terms or our Acceptable Use policy.
  • Provide false information at checkout.
  • Engage in abusive behaviour toward our team.

Upon termination, your agent will be deactivated and no refund will be issued unless the 7-day guarantee applies.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Emirate of Dubai and the United Arab Emirates. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
